Prerequisites

- These terms and conditions are intended for consumers and define the rules and procedure for concluding a remote sales agreement with the consumer through the store.

Definitions
- Consumer - an individual who enters into a contract with the seller within the framework of the store, the subject of which is not directly related to its economic or professional activities.
- Client - any entity that makes purchases through the store.
- Shop - an online store managed by the seller at the Internet address www.nawado.pl.
- The contract was concluded at a distance - an agreement concluded with the client within the framework of an organized system for concluding contracts at a distance (within the store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of communication at a distance until the moment of conclusion of the agreement, inclusive.
- Regulations - these store Rules.
- Order - a statement of the client's will, directed directly to the conclusion of a contract for the purchase and sale of goods or products with the seller.
- Account - the customer's account in the store, which collects data provided by the customer and information about orders placed by them in the store.
- Registration form - the form is available in the store for creating an account.
- Basket - an element of the store's software that shows the products selected by the buyer for purchase, as well as the ability to set and change the order data, in particular the number of products.
- Product - a mobile item / service available in the store, which is the subject of a purchase and sale agreement between the customer and the seller.
- Purchase and Sale Agreement - a product purchase and sale agreement concluded or concluded between the customer and the seller through the online store. A purchase and sale agreement is also understood as an application to product characteristics-a service agreement and a work agreement.

General information
- To the maximum extent permitted by law, the Seller is not responsible for violations, including interruptions in the store's operation caused by force majeure, unauthorized actions of third parties, or incompatibility of the online store with the client's technical infrastructure.
- Viewing the store's product range does not require creating an account. Placing orders by the customer for products in the store's assortment is possible either after creating an account in accordance with the provisions of Section 6 of the rules, or by providing the necessary personal and address data that allows you to complete the order without creating an account.
- The prices shown in the store are in Polish zlotys or euros and are gross prices
- The final (final) amount to be paid by the customer consists of the price for the product and the cost of delivery (including fees for transportation, delivery and postal services), which the customer is informed about on the store's pages at the time of placing an order, including at the time of expressing their will under the purchase and sale agreement.

Creating an account in the store

- The client has the opportunity to delete the account at any time without explanation and without any fees by sending a corresponding request to the seller by email,

Order placement rules
To place an order, you must::
- log in to the store or contact the seller by email;
- select the product you are ordering, and then click add to cart (or equivalent);
- log in to the system or use the opportunity to place an order without registration;
- if you have chosen the option to place an order without registration, please contact the seller by email
- click the "order and payment" button /click the "order and payment" button and confirm the order by clicking on the link sent in the email,
- choose one of the available payment methods and, depending on the payment method, pay for the order on the specified date, in accordance with Section 8, clause 3.

Suggested shipping and payment methods
- The customer can use the following methods of delivery or receipt of the ordered product:

- The client can use the following payment methods::
- Payment by bank transfer to the seller's account
- Electronic payments

Execution of the purchase and sale agreement
- The conclusion of a purchase and sale agreement between the client and the seller occurs after the client has previously placed an order
- After placing an order, the seller immediately confirms its receipt and simultaneously accepts the order for sale. Confirmation of receipt of the order and its acceptance for execution is carried out by sending the seller to the client a corresponding email to the client's email address specified when placing the order, which contains at least the seller's statements about receipt of the order and its acceptance for execution, as well as confirmation of the conclusion of the purchase and sale agreement. After the client receives the above-mentioned email, a purchase and sale agreement is concluded between the client and the seller.
- If selected by the client:
- payment by bank transfer, electronic payments or payment cards, the customer must make the payment within 10 calendar days from the date of conclusion of the purchase and sale agreement.Otherwise, the order will be canceled.
- The product will be sent by the seller within the time period specified in its description (in accordance with paragraph 5 of this paragraph), in the order chosen by the customer when placing the order.
- And when ordering products with different delivery dates, the delivery time is the longest specified time.
B When ordering products with different delivery dates, the customer has the option to request delivery of products in parts or delivery of all products after completing the entire order.
- The beginning of the delivery period for goods to the buyer is calculated as follows:
- If the client chooses the payment method by bank transfer, electronic payment or payment card-from the date of recognition of the Merchant's bank account.

- Delivery of goods to the buyer is paid for, unless otherwise provided by the purchase and sale agreement. The costs of product delivery (including transportation, delivery, and postal service fees) are indicated to the buyer on the pages of the online store and during the order processing process, including when the client expresses his will to be bound by the purchase and sale agreement.
- Personal acceptance of goods by the buyer is free of charge.

Right to terminate the contract
- The consumer can withdraw from the purchase and sale agreement within 14 days without giving any reason.
- The period referred to in paragraph 1 begins with the delivery of the product to the consumer or to the person indicated by him, other than the carrier.
- In the case of a contract that includes several products that are delivered separately, in batches or in parts, the period specified in paragraph 1 begins with the delivery of the last item, batch or part.
- The consumer can terminate the contract by submitting an application for termination of the contract to the seller. To save the term of termination of the contract, it is enough to send the consumer an application before the expiration of this term.
- The right to terminate the contract does not apply to products made by individual order of the client.
- The application can be sent electronically by sending the application to the seller's email address
- If the consumer sends the application in electronic form, the seller will immediately send the consumer a confirmation of receipt of the application for withdrawal from the contract to the e-mail address specified by the consumer.
- Consequences of contract termination:
- In case of termination of the contract concluded at a distance, the contract is considered not concluded.
- In the event of termination of the contract, the seller reimburses the consumer immediately, no later than 14 days from the date of receipt of the consumer's application for termination of the contract, all payments made by him, including the cost of delivering the goods, with the exception of additional costs arising from the delivery method chosen by the consumer, which differs from the cheapest conventional delivery method offered by the seller.
- The merchant returns the payment using the same payment methods as the consumer used in the original transaction, unless the consumer explicitly agreed to a different solution that does not incur any costs.
- The seller may refrain from returning the payment until the goods are returned, or until they are provided with proof of their return, whichever event occurs first.
- The consumer must send the goods to the seller's address indicated in the correspondence related to the refusal, immediately, no later than 14 days from the day when he informed the seller about the refusal from the contract. The deadline will be saved if the consumer sends the product back before the 14-day deadline expires.
- The consumer bears direct costs for the return of the product,
- The consumer is only responsible for reducing the cost of the product as a result of its use in ways other than what was necessary to determine the nature, characteristics and functioning of the product.
- The right to terminate a contract concluded at a distance is not granted to the consumer in relation to the Contract:
- in which the object of provision is a thing that is not manufactured, manufactured in accordance with the specifications of the consumer or intended to meet his individual needs,
- on the provision of services, if the seller has fully performed the service with the explicit consent of the consumer, who was informed by the beginning of the provision of services that after the seller performs the service, he will lose the right to terminate the contract,
- in which the price or compensation depends on fluctuations in the financial market, which the seller does not control, and which may occur before the deadline for termination of the contract,
- where the subject matter is audio recordings or visual recordings,
- on the provision of digital content that is not recorded on a physical medium, if the service was started with the explicit consent of the consumer

Complaint and guarantee
- The purchase and sale agreement applies to new products.
- Complaints must be submitted in writing and electronically to the seller's addresses specified in these Terms and Conditions.
- The seller responds to the complaint immediately, and if the consumer is a customer-no later than 14 days.

Out-of-court ways to handle complaints and file claims

- The consumer has the following examples of opportunities to use out-of-court methods for handling complaints and making claims:
- The consumer has the right to apply to the Permanent Arbitration Consumer Court referred to in article 37 of the Law of December 15, 2000. On Trade Inspection (from 2014, item 148 of the latest edition). ), with a request to resolve a dispute that arose under the contract concluded with the seller.
- The consumer has the right to apply to the provincial trade Inspection inspector in accordance with article 36 of the Law of December 15, 2000. On Trade Inspection (from 2014, item 148 of the latest edition). ), with a request to initiate mediation proceedings for the peaceful termination of the dispute between the consumer and the seller.
- The consumer can get free assistance in resolving a dispute between the consumer and the seller, also using the free help of a district (city) consumer rights defender or a public organization whose statutory tasks include protecting consumer rights (m.in. Consumer Federation, Association of Polish Consumers).

Personal data in the online store
- The seller is the administrator of personal customer data collected through the online store.
- Customer personal data collected by the administrator through the online store is collected for the execution of the purchase and sale agreement, and if the customer agrees to this, it is also collected for marketing purposes.
- Recipients of personal data of online store customers may include::
- In the case of a customer who uses the delivery method by mail or courier in the online store, the administrator provides the collected personal data of the customer to the selected carrier or intermediary performing delivery on behalf of the administrator.
- In the case of a customer who uses an electronic payment method or a payment card in an online store, the administrator provides the collected personal data of the customer to the selected person who makes the above-mentioned payments in the online store.
- The Client has the right to access and correct the contents of their personal data.
- The provision of personal data is voluntary, although the absence of the personal data specified in the rules that is necessary for concluding a purchase and sale agreement makes it impossible to conclude this agreement.

Final provisions
- Contracts concluded through the online store are concluded in Polish.
- The Seller reserves the right to make changes to the rules for valid reasons: changes in legislation, changes in payment methods and delivery-to the extent that these changes affect the implementation of the provisions of these Rules. The seller will notify the customer of any changes at least 7 days in advance.
- In matters not regulated by these Rules, the widely applicable provisions of Polish law apply, in particular: the Civil Code; the Law on the provision of services in electronic form; the Law on Consumer rights, the Law on the protection of Personal Data.
- The Client has the right to use out-of-court methods of handling complaints and making claims. To this end, they can file a complaint through the EU's online ODR platform, available at: http://ec.europa.eu/consumers/odr/.
